Required Information for a DMCA Takedown Notice

A valid DMCA notice must be a written communication and include substantially the following information:

4. COUNTER-NOTICE PROCEDURE

If you believe that your content was removed by mistake or misidentification, you may submit a DMCA Counter-Notice to our designated agent. The counter-notice must include:

2. Identification of the material that was removed and the location where it appeared before removal.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of a mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Cherry Color BD may be found, and that you will accept service of process from the person who provided the original DMCA notification.

5. REPEAT INFRINGER POLICY

In accordance with the DMCA, Cherry Color BD will terminate the website of users who are determined to be repeat infringers of copyright. We reserve the right to remove content and terminate websites at our sole discretion, without notice, if a someone violates these terms.
